Terms of Service

These Terms of Service ("Terms") govern your use of the Motanasb mobile application and website (the "Service") operated by Almutasaid Establishment For Information Technology ("Almutasaid", "we", "us", or "our"), a commercial entity registered in the Kingdom of Saudi Arabia.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. These Terms are provided in Arabic and English. In the event of any conflict between the two versions, the Arabic version shall prevail. The company reserves the right to modify these Terms without advance notice.

1. Definitions

"Host" — a registered user who creates events and manages guest lists.
"Guest" — a person invited to an event by a Host. Guests may view invitations and submit RSVP responses without creating an account.
"Guard" — a user assigned by a Host to perform QR code check-in at events.
"Package" — a paid subscription plan that determines the features and guest limits available to a Host.

2. Account Registration

You must provide a valid Saudi mobile phone number to register.
You must be at least 18 years of age to create an account.
You are responsible for maintaining the security of your account and for all activities under your account.
You agree to provide accurate, current, and complete information.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

You may use the Service to create and manage event invitations, send invitations via WhatsApp or SMS, track RSVP responses, and use QR code check-in at your events.

You may NOT use the Service to:

Send spam, unsolicited messages, or bulk marketing communications
Import or use guest contact information without having a legitimate relationship with those individuals
Send threatening, harassing, defamatory, or otherwise objectionable content
Impersonate another person or entity
Attempt to gain unauthorized access to the Service or other accounts
Use automated tools, bots, or scrapers to interact with the Service
Upload content that infringes intellectual property rights
Use the Service for any unlawful purpose or in violation of applicable laws in the Kingdom of Saudi Arabia

4. Host Responsibilities

As a Host, you are responsible for the accuracy and legality of all guest data you enter into the Service. You must have appropriate consent or a legitimate basis to share guest contact information for sending invitations. You are also responsible for the content of invitation messages sent through the Service on your behalf.

5. Packages and Payment

The Service offers paid subscription packages with varying features and guest limits. Pricing is displayed in Saudi Riyals (SAR) and may change from time to time — changes will not affect active subscriptions until renewal. Payments are processed securely through a licensed third-party payment provider. All prices are inclusive of applicable taxes unless otherwise stated.

Subscription packages are non-refundable once invitations have been sent. If no invitations have been sent, you may request a full refund within 14 days of purchase by contacting our support team. Refunds are processed to the original payment method. Promotional codes and discounts are non-refundable and non-transferable.

6. Intellectual Property

The Service, including its design, code, templates, graphics, and branding, is owned by Almutasaid and protected by intellectual property laws of the Kingdom of Saudi Arabia and international treaties. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of content you upload (such as custom designs and event photos). By uploading, you grant Almutasaid a limited, non-exclusive license to store and display that content solely to provide the Service. Invitation templates are licensed for personal use only and may not be resold or redistributed.

7. Messaging

Invitations and reminders are sent via a Saudi Arabia-based messaging provider. Message delivery depends on the recipient's network and device — we do not guarantee delivery of every message. Message quotas are determined by your Package tier and unused messages do not roll over.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance or security reasons. We are not liable for any loss resulting from Service unavailability.

9. Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms or use the Service in a way that harms others.
You may delete your account at any time. Upon deletion, your data enters a 30-day grace period before permanent removal.
Upon termination, your right to use the Service ceases immediately. Data retention is governed by our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law in the Kingdom of Saudi Arabia, the Service is provided "as is" without warranties of any kind. Almutasaid shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Almutasaid from any claims, damages, or expenses arising from your violation of these Terms, your use of the Service, or your violation of any third-party rights.

12. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute shall first be attempted to be resolved amicably. If unresolved within 30 days, it shall be submitted to the competent courts in the Kingdom of Saudi Arabia.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.

14. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
Our failure to enforce any provision does not constitute a waiver.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Almutasaid regarding the Service.
